An adjuster was appointed, and the adjusted offer was as follows:
1. The adjusted claim amount was RM79K++ after deducting RM20K for the deductibles.
2. The Adjuster applied a 50% for the subcontractor’s contribution.
3. The servicing agent appealed to the adjuster, informing that the Contractors All Risks (CAR) insurance purchased by the main contractor included all sub-contractors’ work.
Finally, a revised claim offer for RM159K++ was received. The 50% subcontractor’s contribution was removed.
a. There are no mandatory clauses requiring the subcontractor to purchase a separate Contractors’ All Risks (CAR) insurance under the Letter of Award (LOA).
b. All subcontractors’ work is covered under the master CAR policy brought by the main contractor.
c. It is unreasonable to impose the contribution requirement against the subcontractor.
d. The standard practice regarding “claim contribution” involves applying a policy against another policy to share the costs of the claim paid, if the subcon has a separate CAR policy.
e. A correct understanding and interpretation of the terms and conditions is essential.
